4. User Conduct & Safety During Matches
4.1 Platform Role
SuperServe provides a platform that enables users to connect and arrange padel matches. We do not organise, supervise, manage, or control matches and are not involved in the physical activities that take place between users.
All matches are arranged directly between users, and participation is entirely at your own discretion and risk.
4.2 Personal Responsibility
By using the platform to arrange or participate in matches, you acknowledge and agree that you are solely responsible for:
- your own safety, wellbeing, and conduct during any match or physical activity;
- determining whether you are physically fit and medically able to participate; and
- ensuring that any court, venue, equipment, or playing environment is suitable and safe for your use.
You acknowledge that padel and related physical activities involve inherent risks, including the risk of injury.
4.3 Interaction Between Users
You are solely responsible for your interactions with other users, both on and off the platform.
You agree to behave respectfully, responsibly, and safely at all times. Harassment, abusive behaviour, discrimination, threatening conduct, or behaviour that may endanger or distress other users is strictly prohibited.
4.4 Safety During Matches
You acknowledge that:
- you are solely responsible for deciding whether to participate in any match or activity;
- you should take appropriate precautions when meeting other users, including meeting at recognised public sports venues where possible; and
- you are responsible for obtaining any insurance coverage you consider appropriate, including personal accident or medical insurance.
We strongly recommend that users:
- only participate at reputable or appropriate padel facilities;
- communicate clearly with other players before attending matches; and
- leave or cancel a match immediately if they feel unsafe or uncomfortable.
4.5 No Liability for Offline Activity
To the maximum extent permitted by law, SuperServe is not responsible or liable for:
- any injury, loss, damage, accident, or harm arising during or after participation in a match or activity;
- disputes or disagreements between users;
- the conduct, actions, or omissions of users during in-person interactions; or
- any user failing to attend, complete, or participate in a match.
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
4.6 Reporting and Platform Safety
If you experience harassment, unsafe behaviour, misconduct, or other safety concerns involving another user, you may report the matter to us at hello@superserve.app.
We may review reports and take action at our discretion, including issuing warnings, suspending accounts, or permanently removing users from the platform.
4.7 Right to Remove Users
We reserve the right to suspend, restrict, or permanently remove any user who, in our reasonable opinion, poses a risk to the safety, integrity, reputation, or proper operation of the platform or its users.
5. Payments and Refunds
Payments are processed securely by third-party payment providers, including Stripe. SuperServe does not store full payment card details.
By making a purchase, you agree to pay all applicable fees associated with your booking, event, or service.
Prices are displayed in pounds sterling (£) and include applicable taxes where required.
Payment is due at the time of booking or purchase unless otherwise stated.
Refunds
Refund eligibility depends on the type of booking and may also be subject to any additional terms set by coaches, event organisers, or venues.
Unless otherwise stated at the time of purchase:
- Event tickets: Refunds are available if cancelled at least 48 hours before the scheduled event.
- Coach sessions: Refunds are available if cancelled at least 24 hours before the scheduled session.
- No-shows: No refunds will be issued for users who fail to attend a booked session or event.
Processing of Refunds
Where a refund is approved, it will be processed to your original payment method within 5-10 business days, subject to processing times of your payment provider.
Exceptions and Disputes
SuperServe may, at its reasonable discretion, approve refunds outside of the above policy in cases of error, technical failure, or exceptional circumstances.
We may also require additional information before processing a refund or resolving a dispute.
6. Content Ownership
6.1 Your Content
You retain ownership of any content you upload, post, or submit on the platform ("User Content"), including text, images, and other materials.
By submitting User Content, you grant SuperServe a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, host, store, reproduce, modify (for technical purposes such as formatting), display, and distribute your User Content for the purposes of operating, improving, and marketing the platform, including enabling technical service providers (such as hosting and infrastructure providers) to process such content on our behalf.
This licence ends when you delete your User Content or your account is deleted, except where:
- your content has been shared with other users and they have retained copies of it, or
- retention is required for legal, regulatory, security, or legitimate business purposes.
You confirm that you own or have all necessary rights, licences, and permissions to submit any User Content and that your content does not infringe the rights of any third party.
6.2 Responsibility for Content
You are solely responsible for the User Content you upload and its legality.
We do not actively monitor User Content and are under no obligation to do so, but we reserve the right to remove, restrict access to, or disable content where reasonably necessary, including where it:
- breaches these Terms,
- is unlawful, offensive, or harmful, or
- is otherwise deemed inappropriate.
6.3 Our Content and Intellectual Property
All content, features, design elements, software, and code within the platform (excluding User Content) are owned by or licensed to SuperServe and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform solely for its intended purpose.
You may not:
- copy, modify, distribute, or reproduce any part of the platform,
- reverse engineer or extract source code, or
- create derivative works based on the platform without our prior written permission.
6.4 Feedback
If you provide feedback, suggestions, or ideas, you agree that SuperServe may use them freely, without restriction or compensation to you.
7. Coaches and Service Providers
SuperServe operates as a marketplace platform that connects users with independent coaches and service providers.
Coaches and service providers are independent third parties and are not employees, agents, or representatives of SuperServe. Nothing in these Terms creates any partnership, joint venture, or employment relationship between SuperServe and any coach or service provider.
Coaches are solely responsible for:
- the quality, safety, and delivery of their services,
- compliance with all applicable laws and regulations, and
- maintaining any necessary qualifications, certifications, and insurance required to provide their services.
SuperServe does not control, supervise, or guarantee the services provided by coaches and is not responsible for any actions, omissions, or conduct of coaches or service providers.
Users engage coaches and service providers at their own discretion and risk.
8. Event Organizers
Event organizers using our platform agree to:
- Provide accurate event information
- Honor all tickets sold through the platform
- Comply with venue regulations and safety requirements
- Process refunds according to stated policies
9. Limitation of Liability
SuperServe is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not responsible for user-generated content or third-party services
- Our total liability to you for any claims arising out of or relating to the platform shall not exceed the total platform fees paid directly to SuperServe by you in the 12 months preceding the event giving rise to the claim
- We do not guarantee uninterrupted, secure, or error-free service
10. Indemnification
You agree to indemnify and hold harmless SuperServe, to the fullest extent permitted by law, from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- your breach of these Terms,
- your misuse of the platform,
- your violation of any applicable law or third-party rights, or
- any content you upload, post, or share through the platform.
This indemnity will not apply to the extent that any claim arises from our own negligence, wilful misconduct, or breach of these Terms.
We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defence of such claim.
11. Account Termination
We reserve the right to suspend or terminate accounts that violate these terms or engage in harmful behavior. You may also delete your account at any time through your account settings.
12. Modifications to the Service
We may update, modify, or discontinue any part of the platform from time to time, including features, functionality, or availability, for reasons such as improving the service, complying with legal requirements, or making technical changes.
Where we make material changes or discontinue core features, we will provide reasonable notice where practicable, for example by email or in-app notification.
We will aim to give advance notice where such changes are likely to have a significant impact on your use of the platform.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
You agree that the courts of England and Wales shall have jurisdiction to resolve any disputes arising out of or in connection with these Terms. However, this does not affect any mandatory legal rights you may have as a consumer under the laws of your country of residence.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, legal requirements, or operational needs.
Where we make material changes, we will provide reasonable notice to you, such as by email or in-app notification.
The updated Terms will become effective on the date specified in the notice.
By continuing to use the platform after the updated Terms take effect, you agree to be bound by them. If you do not agree to the updated Terms, you should stop using the platform.
